COMMERCIAL TRUCKS

Commercial trucks include many types of trucks including tractor-trailers and delivery trucks. Commercial trucks travel on roads throughout Kentucky and Ohio twenty-four hours each day. Some of this commercial truck traffic occurs on interstate highways and other traffic occurs on state and local roads.

Commercial truck drivers must have a valid Commercial Drivers License (CDL) and must comply with various government regulations (such as driver eligibility, permissible levels of alcohol, and maintaining log books) that do not apply to drivers of automobiles.

Due to the size and weight of commercial trucks, accidents involving these types of trucks often cause significant injuries and sometimes death.

SIMILARITIES AND DIFFERENCES IN AUTOMOBILE ACCIDENTS AND COMMERCIAL TRUCK ACCIDENTS

Automobile accidents and commercial truck accidents have some similarities and some differences. The primary similarity is that an injured person’s claim has the same legal value regardless of whether the damages were caused by an automobile accident or commercial truck accident. In other words, an injured person is not entitled to any more or less compensation depending on whether they were injured in an automobile accident or a commercial truck accident. The primary difference between automobile accidents and commercial truck accidents is proving the liability of the automobile driver or the commercial truck driver who caused the accident. Unlike automobile drivers, commercial truck drivers must comply with various government regulations (see above). A commercial truck driver’s failure to comply with these government regulations often affects the driver’s (and his employer’s) liability for causing the accident.
